This policy explains how iSmartMedia (“iSmartMedia”, “we”, “us”) handles personal data when you visit our website, contact us, apply to link a channel, or use our YouTube CMS, Content ID and music distribution services. We are based in India and process personal data in line with the Digital Personal Data Protection Act, 2023 (“DPDP Act”) and other applicable Indian law. For the purposes of the DPDP Act, iSmartMedia is the data fiduciary for the data described here.
1. Data we collect
Data you give us
- Your name, email address and WhatsApp or phone number.
- YouTube channel URLs and other links you share with us.
- Information about your channel, such as content type and approximate monthly revenue band.
- Messages you send through our forms, by email or on WhatsApp.
- If you become a partner: agreement details, identity and rights documents you provide, and payout details (for example bank, PayPal or Payoneer information).
Data from linked channels
Once a channel is linked to our YouTube CMS, YouTube makes channel data available to us through its Content Manager. This includes content and asset information, Content ID claims, analytics and earnings data. We use it to provide the services and prepare your statements.
Data collected automatically
Like most websites, our servers record basic technical data such as IP address, browser type, pages visited and referring page. We may use cookies or similar technologies needed to run the site, and privacy-respecting analytics to understand how the site is used. You can block or delete cookies in your browser settings; the core site will still work.
2. Why we use your data
- To reply to your inquiry and review your channel.
- To prepare a quote and a written agreement.
- To link and manage channels in our CMS, register Content ID assets and handle claims.
- To distribute music you ask us to distribute.
- To calculate earnings, issue statements and make payouts, including referral commissions.
- To communicate with you about your account by email or WhatsApp.
- To keep our website and services secure and to prevent fraud or misuse.
- To meet legal, tax and accounting obligations.
3. Consent and legal basis
We process personal data on the basis of your consent, which you give when you submit a form or contact us, and for legitimate uses permitted by the DPDP Act, such as performing an agreement you have entered into with us or complying with law. You can withdraw consent at any time by contacting us. Withdrawal does not affect processing already carried out, and we may need to keep some data where the law requires it. If you withdraw consent needed to run a service, we may not be able to continue providing that service.
4. Who we share data with
We do not sell your personal data. We share it only where needed:
- Service providers who help us run the business, such as website hosting, database, email delivery and payment providers. They may process data only on our instructions.
- YouTube / Google and other platforms, to the extent needed to link channels, manage rights and distribute content you ask us to handle.
- Authorities or advisers where required by law, court order or to protect our rights, and our professional advisers under confidentiality.
- A successor business if iSmartMedia is involved in a merger or sale, subject to this policy.
5. Transfers outside India
Some of our service providers and the platforms we work with store or process data outside India. Where we transfer data abroad, we do so as permitted under the DPDP Act and any restrictions notified by the Government of India, and we take reasonable steps to keep the data protected.
6. How long we keep data
We keep personal data only as long as needed for the purposes above. Inquiry data that does not lead to a partnership is deleted or anonymized after a reasonable period. Partner, statement and payout records are kept for as long as the agreement lasts and afterwards for as long as tax, accounting or other legal obligations require.
7. Security
We use reasonable technical and organizational safeguards, including access controls and encrypted connections, to protect personal data. We never ask for your YouTube or Google password; channels are linked through YouTube’s own invitation process. No system is perfectly secure. If a personal data breach occurs, we will notify affected people and the Data Protection Board of India as the DPDP Act requires.
8. Your rights
Under the DPDP Act you have the right to:
- Get a summary of the personal data we hold about you and how we process it.
- Correct, complete or update inaccurate or incomplete data.
- Ask us to erase data we no longer need, subject to legal retention requirements.
- Withdraw consent you have given.
- Have your grievances addressed by us, and escalate to the Data Protection Board of India.
- Nominate another person to exercise your rights in case of death or incapacity.

9. Grievances
If you have a concern about how we handle your data, email us at cms@ismartmedia.in or use our contact page, with “Privacy grievance” in the subject. We will acknowledge your complaint and respond within the time required by law. If you are not satisfied with our response, you may approach the Data Protection Board of India.
10. Children
Our services are meant for adults. If you are under 18, a parent or lawful guardian must contact us and give verifiable consent on your behalf before we process your data. We do not track or target children with advertising.
11. Changes to this policy
We may update this policy from time to time. The “Last updated” date at the top shows when it last changed. If a change is significant, we will tell partners directly.
